1. Agreement to Terms

By accessing or using SuprSketch's services, including our website, real-time art streaming platform, and Photoshop plugin (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Services.

2. Definitions

• "Platform" refers to SuprSketch's website, streaming services, and associated tools
• "Artist" refers to users who create and stream content through the Platform
• "Subscriber" refers to users who pay for access to Artist content
• "Content" refers to any artistic works, streams, or materials created or shared through the Platform
• "Moderator" refers to individuals designated by Artists or SuprSketch to enforce Platform rules

3. Account Terms

3.1 Account Creation

• You must be at least 18 years old to create an account
• You must provide accurate, current, and complete information
• You are responsible for maintaining the security of your account
• You must notify us immediately of any unauthorized access

3.2 Account Types

• General User Accounts: Basic platform access
• Artist Accounts: Content creation and streaming privileges
• Subscriber Accounts: Access to paid content streams

3.3 Administrative Authority

• SuprSketch Administrators maintain absolute discretion over all account privileges and access
• Accounts may be modified, suspended, or terminated at any time without notice or explanation
• Access to any part of the Platform may be revoked or limited at SuprSketch's sole discretion
• Feature availability and access levels may be adjusted without prior notice

3.4 Account Termination

• We reserve the right to terminate or suspend accounts at any time, with or without cause
• No prior warning or explanation is required for account actions
• SuprSketch's decision regarding account status is final and binding
• No refunds will be issued for prepaid services in the event of termination

4. Content Rights and Ownership

4.1 Artist Rights

• Artists retain ownership of their original content
• Artists grant SuprSketch a license to store and display content
• Artists may set their own content visibility and access rules

4.2 Subscriber Rights

• Subscribers receive viewing access only
• No right to download, record, or redistribute content
• Access contingent on active subscription status

4.3 Platform Rights

• Right to store and display content
• Right to moderate and remove content
• Right to maintain platform integrity

4.4 Platform Discretion

• SuprSketch maintains absolute discretion over content visibility and accessibility
• Content may be removed, hidden, or modified at any time without notice
• Platform features and functionality may be adjusted or limited at SuprSketch's discretion
• Suprsketch will not release content without artist express approval
• No explanation is required for content-related decisions

5. Subscription Terms

5.1 Payment Terms

• All payments processed through Stripe
• No refunds on subscription payments
• Access terminated upon subscription expiration
• Automatic renewal unless cancelled

5.2 California Auto-Renewal Notice

IMPORTANT: Your subscription will automatically renew for subsequent periods of the same duration as the original term. The subscription fee will be charged to your payment method on file. You can cancel at any time through your account settings or by contacting support. If you cancel, you will maintain access until the end of your current billing period.

6. Prohibited Activities

Users may not:

• Record or download content without permission
• Share account credentials
• Circumvent platform security measures
• Harass or discriminate against others
• Post illegal or infringing content
• Impersonate others
• Manipulate platform features
• Interfere with platform operations
• Engage in unauthorized commercial activities

6.1 Administrative Authority

• The list of prohibited activities is non-exhaustive
• SuprSketch Administrators may determine any activity to be prohibited at their sole discretion
• Activities may be deemed prohibited without prior notice or listing in these terms
• Consequences for prohibited activities are at the absolute discretion of SuprSketch Administrators

7. Moderation and Enforcement

7.1 Moderation Structure and Authority

• SuprSketch Administrators have absolute and final discretion over all moderation decisions
• SuprSketch Administrators may take any moderation action, including account suspension or termination, without providing explanation or evidence
• All moderation decisions, regardless of tier or severity, are subject to override or modification by SuprSketch Administrators at any time
• No proof, justification, or explanation is required for moderation actions taken by SuprSketch Administrators
• The violation tier system serves as a general guideline but does not limit SuprSketch Administrators' authority to take immediate and final action as they deem appropriate
• Moderation decisions supersede all other platform systems and processes
• SuprSketch reserves the right to modify, expand, or disregard standard moderation procedures at its discretion

7.2 Violation Tiers and Consequences

Tier 1: Minor Violations (Warning)

• First-time inappropriate language
• Spamming chat
• Off-topic discussions

Tier 2: Moderate Violations (24-48 hour mute)

• Repeated minor violations
• Harassment
• Disruptive behavior
• Excessive self-promotion

Tier 3: Serious Violations (7-30 day chat ban)

• Continued moderate violations
• Targeted harassment
• Hate speech
• Attempting to circumvent moderation

Tier 4: Severe Violations (Permanent chat ban)

• Repeated serious violations
• Extreme hate speech
• Coordinated harassment
• Threatening behavior

Tier 5: Platform Ban Violations (Permanent account ban)

• Criminal activity
• Explicit threats
• Extreme violations of terms
• DMCA/Copyright violations with proof
• Repeated attempts to circumvent bans

7.3 Appeals Process

• 15-day waiting period before appeal submission
• One appeal per user lifetime
• Appeals must include valid evidence
• Decisions are final

8. DMCA and Copyright

8.1 DMCA Notices

• Submit to: dmca@suprsketch.com
• Response within 72 hours
• 14-day investigation period
• Must include required statutory elements

8.2 Copyright Disputes

• Formal mediation process
• Proof of original work required
• Clear documentation of creation dates
• No content holds without evidence

9. Platform Authority

• The enforcement of these terms, including interpretation of violations, is at SuprSketch's sole discretion
• SuprSketch may enforce these terms selectively or modify enforcement standards without notice
• No action or inaction by SuprSketch creates a precedent or waives SuprSketch's right to enforce any term
• SuprSketch's interpretation of these terms is final and binding

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes become effective one day after notification via email. Continued use of the Platform constitutes acceptance of modified Terms.

12. Final Authority

• These Terms of Service are subject to interpretation and enforcement at SuprSketch's sole discretion
• SuprSketch maintains the right to make exceptions to any of these terms
• Any ambiguity in these terms will be resolved at SuprSketch's discretion
• SuprSketch's decisions regarding these terms are final and binding

13. Enterprise and Institutional Use

• Enterprise companies, educational institutions, government agencies, and other organizations with more than 50 employees are prohibited from using our Services without prior written authorization from SuprSketch Corp.

• Institutional use includes, but is not limited to:
    - Commercial use by enterprises
    - Educational institution deployment
    - Government agency utilization
    - Organizational-wide implementation
    - Multi-user corporate access

• Authorization requests must be submitted to: enterprise@suprsketch.com

• Unauthorized institutional use may result in immediate termination of access and potential legal action

• SuprSketch Corp. reserves the right to:
    - Deny institutional use requests without explanation
    - Revoke previously granted authorizations at any time
    - Implement special pricing for authorized institutional use
    - Require additional agreements for institutional access

• Individual employees of such organizations may maintain personal accounts for non-institutional use, provided such use is not part of or in support of institutional activities

14. Live Streaming Services

14.1 Stream Quality and Technical Expectations

• Stream quality is dependent on multiple factors including artist's connection, viewer's connection, and platform load
• SuprSketch does not guarantee specific quality levels or uninterrupted service
• Resolution and frame rates may vary based on network conditions
• Users are responsible for their own internet connection quality
• The platform may automatically adjust quality settings to maintain stability

14.2 Technical Interruptions and Refunds

• SuprSketch does not provide refunds for technical interruptions of any kind
• This includes but is not limited to:
    - Internet connectivity issues
    - Server maintenance or failures
    - Browser or device compatibility issues
    - Power outages
    - Plugin or software failures
• Subscription fees are non-refundable regardless of service availability or quality
• Users acknowledge that occasional technical issues are inherent to streaming services

14.3 Real-Time Content Guidelines

• All streamed content must comply with our platform policies in real-time
• Artists must immediately address content violations when notified
• Content may be terminated without warning if it violates our terms
• SuprSketch maintains the right to:
    - Monitor streams in real-time
    - End streams that violate policies
    - Restrict streaming privileges
    - Implement content filtering

14.4 Live Chat and Moderation

• Chat privileges may be revoked at any time without warning
• Automated moderation systems may be used to filter content
• Artists may appoint their own chat moderators
• SuprSketch administrators have final authority over all chat moderation
• Chat logs are retained indefinitely for safety and moderation purposes
